Biogena USA Inc. is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit biogena-usa.com or na.biogena-one.com (the "Sites"). It also describes your rights under applicable US and California privacy law.

Information we collect

You can browse our Sites without disclosing any personally identifiable information (PII). Standard server log data (date/time, page requested, data volume, browser and device information, abbreviated IP address) is collected automatically for every visit to keep the Sites running and secure; this data is not linked to your identity.

We collect PII only when you voluntarily provide it — for example when you register an account, place an order, subscribe to a newsletter, fill out a contact or return form, use live chat, or open a support ticket. Categories of personal information we may collect include: identifiers (name, email address, postal address, phone number, IP address); commercial information (purchase history, products viewed); internet or network activity (browsing history on our Sites, search queries, interaction with ads); and inferences drawn from the above to understand your preferences.

Sharing your information

We do not sell, rent, or trade your PII to outside parties except as described here:

  • Service providers: we share data with vendors who help us operate the Sites or fulfill orders (e.g., payment processors, banks, shipping carriers), under confidentiality obligations and only to the extent needed.
  • Legal requirements: we may disclose information when required by law, court order, or government authority, or to protect our rights, property, or the safety of our users or the public.
  • Business transfers: if Biogena USA Inc. is acquired or merges with another company, your information may transfer as part of that transaction, subject to this policy.
  • With your consent: in any other circumstances with your express prior consent.

Payment data you enter is transmitted directly to our payment processor (e.g., PayPal, Stripe) for processing; we do not store full credit card numbers on our servers. Non-personally-identifiable, aggregated visitor data may be shared for analytics or marketing purposes.

Cookies and tracking technologies

We use session cookies and longer-term cookies (retained up to 30 days) to keep the Sites and shopping cart functioning and to remember your preferences. You can instruct your browser to refuse all cookies or to alert you when cookies are sent; note that some features of the Sites may then not function properly.

We use the following third-party tracking tools, which may set their own cookies:

  • Meta (Facebook) Pixel and remarketing — allows Meta to recognize that you visited our Sites if you are logged into Facebook. Manage your settings at facebook.com/ads/preferences
  • MyFonts — serves custom web fonts and receives your IP address to deliver font files.

You may also opt out of interest-based advertising by industry opt-out tools such as optout.aboutads.info or optout.networkadvertising.org.

How we protect your information

Our Sites are regularly scanned for vulnerabilities and malware. Personal data is stored behind secured networks accessible only to authorized personnel bound by confidentiality obligations. Sensitive and payment information is encrypted via SSL/TLS during transmission. Payment transactions are processed through a dedicated payment gateway; we do not retain payment card data on our own servers.

Your California privacy rights (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA) gives you specific rights regarding your personal information:

  • Right to Know: you may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties with whom we share it.
  • Right to Delete: you may request that we delete personal information we collected from you, subject to certain exceptions (e.g., completing a transaction, legal obligations).
  • Right to Correct: you may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale or Sharing: we do not sell personal information for monetary consideration. If we share personal information with third parties for cross-context behavioral advertising, you have the right to opt out.
  • Right to Limit Use of Sensitive Personal Information: to the extent we collect sensitive personal information, you may direct us to limit its use to what is necessary to perform the services you requested.
  • Right of No Retaliation: we will not discriminate against you for exercising any of these rights.

To submit a verifiable consumer request, contact us at service@biogena-usa.com or +1 213 444 7902. We will respond within 45 days (extendable by a further 45 days with notice). You may designate an authorized agent to make a request on your behalf; we may require written authorization and verification of your identity. We will verify your identity by matching information you provide against information in our records.

California Civil Code Section 1798.83 ("Shine the Light") allows California residents to request information about disclosure of personal information to third parties for those parties' own direct marketing purposes. To make such a request, email us at service@biogena-usa.com with the subject line "Shine the Light Request."

CalOPPA and Do Not Track

We comply with the California Online Privacy Protection Act (CalOPPA): you may browse anonymously, this policy is linked from our homepage, and we will note any material changes here with an updated effective date. We do not currently respond to browser "Do Not Track" signals, as no uniform standard for such signals has been established. We do permit third-party behavioral tracking as described above under Cookies and tracking technologies.

CAN-SPAM compliance

Marketing emails we send comply with the CAN-SPAM Act: they will not use misleading subject lines or sender addresses, will be identified as advertising where required, will include our physical business address, and will include a clear mechanism to unsubscribe. Opt-out requests are honored promptly and within 10 business days.

Data breach notification

In the event of a data breach affecting your personal information, we will notify you in accordance with applicable state breach notification laws (including California Civil Code Section 1798.82), without unreasonable delay and in no case later than required by law. Notice will be provided by email to the address in your account.

Children's privacy

Our Sites are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us at service@biogena-usa.com and we will delete it promptly.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page with an updated effective date. For material changes, we will provide additional notice (e.g., a banner on the Site or an email to your account address). Your continued use of the Sites after changes become effective constitutes acceptance of the updated policy.
